Trade Markets affected: All
Measure: Request for Comments and Notice of a Public Hearing Regarding the 2023 Special 301 Review.
Why this matters: Intellectual property (IP) represents 80% or more of a business’s value. In recognition of this, the Office of the United States Trade Representative (USTR) is Congressionally mandated to conduct a yearly review to identify countries that deny adequate and effective protection of IP rights or deny fair and equitable market access to U.S. persons who rely on IP protection. Based on this review, the U.S. Trade Representative determines which, if any, of these countries to identify as Priority Foreign Countries.
More information: The deadline for submitting written comments is January 30, 2023. Additional details on the Special 301 Review and the process for submitting comments are available in the Federal Register notification.
Potential action: If your or your client’s business is experiencing any problems related to a violation of your/their IP rights in foreign markets as a result of foreign government policies or practices (as opposed to a private dispute), then the Special 301 Review provides an opportunity for your voice to be heard and for the U.S. government to engage foreign governments and advocate to remedy the issue. The Central-North Florida District Export Council would be pleased to provide relevant support to you or your client in preparing and submitting these comments.
